“MOTION: To move that the Board of Selectmen approve the application subject to Board of Appeals decision #4823 which includes a limit of eight vehicles for sale. Motion by: Tracy Post Seconded by: Erik Tolley Discussion on the Motion: Selectman Holcomb questioned how the parking spaces at J-Mart were currently being utilized and asked if there were enough spaces to accommodate the convenient store customers, employees and the cars for sale. Mr. Imad stated that three or four vehicles would be parked on the left hand side by the fence, and the rest would be parked to the right. The woman accompanying Mr. Imad stated that some of the spaces were previously used to store U-Haul trucks which were no longer there. Approve the Town of Yarmouth Cemetery Policy for vendors
To move that the Board of Selectmen approve the Town of Yarmouth Cemetery Policy for vendors.
“MOTION: To move that the Board of Selectmen approve the Town of Yarmouth Cemetery Policy for vendors. Motion by: Erik Tolley Seconded by: Norm Holcomb Discussion on the Motion: Selectman Holcomb asked if there was a penalty. Mr. Colby explained that, if the contractor/vendor was in violation of any of the items in the policy, there were elements within the rules and regulations that would give remedies associated with operations taking place within the cemetery. Chairman Stone asked if there were any current problems that this supplemental policy was aimed at, or that had prompted the drafting of this policy. Mr. Colby explained that, whether it was a cremation location or burial site that had been left in an inappropriate condition (i.e. open, not properly loamed or seeded, or concrete left throughout the site), the cemetery staff had to spend a significant amount of time cleaning the area, which could have been avoided if the contractor/vendor had been given clear guidance. Selectman Post suggested that if the Town staff had to perform this kind of cleanup work, perhaps at some future date, they should consider adding a cleanup fee to be charged to the contactors. Mr. Colby agreed that would be something that could be looked at. AMMENDED MOTION: To move that the Board of Selectmen approve the Town of Yarmouth cemetery policy for vendors, with a provision for a six-month review. If at that time they see that these guidelines are not being effective, they may want to consider implementing a penalty or fine for non-compliance. Motion by: Erik Tolley Seconded by: Norm Holcomb Yea 5 Nay 0.” (Motion: Tolley, second: Holcomb)
