“Mr. Handler moved that the DPW plow from Raptor to Round Cove under the condition that the : residents improve the road so that it is a passable road in the eyes of the DPW to plow. Seconded by Mr. MacAskill. : Mr. Howell commented that he is unsure of where this one goes after this. In all deference to Mr. Fratus he lost that argument in state court accordingly because Fratus as an abutter and an uninjured traveler, does not have a private right of action to compel the Town to make improvements or repairs nor was he entitled to Mandamus relief. That was the ruling of the court on two different levels. Vote: 3:2 against. Motion failed.” (Motion: Handler, second: MacAskill)
