“Motion to disband the Fire Station Building Subcommittee effective May 5, 2026 was made by Select Board Member Zager and seconded by Selectmen Carvalho. The motion carried unanimously. Discussion on Roadway Complaint - Route 79, Forge Road & Malbone Road Town Administrator Deb Pettey introduced this item, explaining that the affected stretch of roadway at the railroad crossing was reconfigured by the MBTA as part of a rail installation project and has been failing. The Town Administrator noted she had previously compelled the MBTA to make repairs, but the roadway is deteriorating again, and she has contacted MBTA representative Ms. Fox to report the ongoing issue. A resident, Steve Tripp, addressed the Board and identified failing seams at the Forge Road crossing as well as a depression on Route 79 in front of a residential property. He raised concern about who bears financial responsibility for repairs and flagged a drainage issue where the catch basin appears higher than the surrounding pavement depression, creating a potential winter ice hazard. Highway Surveyor Chuck noted that groundwater naturally leaching from the adjacent slope is the likely cause of continued pavement failure. He stated that a subdrain at the toe of the slope, connected to existing catch basins, could mitigate the problen-though the MBTA's engineer previously disagreed with that approach. Highway Surveyor confirmed that the crossing is within the MBTA's layout and is ultimately their maintenance responsibility. The Board agreed to authorize Town Administrator Pettey to draft a formal letter from the Board of Selectmen to the MBTA and Ms. Fox requesting a comprehensive review of all railroad crossing conditions, with particular emphasis on the Forge Road and Malbone Road locations. The Board concluded that a letter from the Board would carry greater weight than administrative correspondence alone. - Motion to authorize the Town Administrator to draft a letter from the Board of Selectmen to the MBTA regarding the condition of all railroad crossings in Freetown, with particular attention to Forge Road and Malbone Road, was made by Selectmen Zager and seconded by Selectmen Carvalho. The motion carried unanimously.” (Motion: Zager, second: Carvalho)
