D. Authorization of Lien on 32 Mill Hill Road – Discussion and Vote

Authorize the Statement of Claim for 32 Mill Hill Road in the amount of $51,875.50 and to direct staff to record the lien and process it for addition to the tax roll

Minutes, page 9

ApprovePassed · Unanimous, 5 present

To authorize the Statement of Claim for 32 Mill Hill Road in the amount of $51,875.50 and to direct staff to record the lien and process it for addition to the tax roll

From the minutes

“Mr. Dykens made a motion to authorize the Statement of Claim for 32 Mill Hill Road in the amount of $51,875.50 and to direct staff to record the lien and process it for addition to the tax roll. Second: Ms. Davis Brian Phillips, Chatham, asked if there would be interest applied to the lien. Director Berman stated the lien accrues interest in accordance with the statute authorizing these types of liens until it is committed as a tax upon the property, at which point the lien beings accruing interest at the rate applicable to the municipal taxes. Director of Finance Carrie Mazerolle stated that the interest on tax title was reduced from 16% to 8%. The lien stays on the tax bill for a year and, if unpaid after a year or more depending on circumstances, the Tax Collector has the option to change it to tax title. Mr. Phillips stated his opinion that doing so was not fair to the property owner. The Board reiterated that this is not a tax but a lien. The Town went through due process and handled the situation properly. The Board asked if it has discretion on the 8% interest rate. The 8% interest rate is set by Massachusetts General Law that went into effect on November 1, 2024. Chair Nicastro called for a vote on the motion that had been made and seconded. Roll Call Shareen Davis: yes Jeffrey Dykens: yes Cory Metters: yes Stuart Smith: yes Dean Nicastro: yes.” (Motion: Dykens, second: Davis)
