Amendment rejected
What it means
The Senate Ways and Means version of a broad criminal justice bill covering juvenile justice, drug laws, sentencing and fines, pretrial release, records, and prison conditions. It sets the 'age of criminal majority' at 19 in place of 18 for juvenile court purposes, sets 12 as the lowest age for a delinquency case, and adds pre-arraignment diversion for children. It rewrites drug penalties: removes some minimum sentences, repeals several drug-law sections, changes one set of trafficking penalties so the lowest tier starts at 100 grams, and adds fentanyl, carfentanil and related drugs to Class A. It raises the dollar line for felony larceny and related crimes from $250 to $1,500, creates manslaughter penalties for corporations (fine of at least $250,000), and makes changes to court fines and fees based on ability to pay. It also rewrites pretrial release and dangerousness-hearing rules, expands record sealing and expungement, sets rules and limits for restrictive housing in prisons and jails, creates conditional medical parole for terminally ill or permanently incapacitated prisoners, and sets up several task forces.
