Amendment adopted
What it means
Creates a new state law (chapter 40X) that lets property owners in a defined area petition their city or town to form a community benefit district run by a nonprofit corporation. Owners who would pay more than 50 per cent of the proposed fees must sign, the local governing body must hold a public hearing and vote, and in towns of 10,000 people or fewer town meeting must also approve. The district can charge property owners fees of up to ½ of 1 per cent of the assessed value of member property per year to pay for extra services such as maintenance, security, parking, parks, events and business promotion; residential property whose homeowner is eligible for a property tax exemption under state law or a local ordinance or by-law pays no fee and tax-exempt owners may choose whether to pay. Unpaid fees can become a lien on the property, and a district can be dissolved by its board with a ⅔ vote of property owners.
