If the Special Permits Committee makes a determination that the proposed plans are not in conformance with the Site Plan, the Petitioner shall be required to file a Special Permit Petition seeking approval to modify the Site Plan; 2. The hours of operation shall be Monday - Friday from 6:00 a.m. to 7:00 p.m.; 3. Except in the event of an emergency, work on the exterior of the site shall be from 7:00 a.m. - 6:00 p.m. Monday through Friday, and 8:00 a.m. - 5:00 p.m. on Saturdays. No work on the exterior of the site shall be permitted on Sunday, or state and federal holidays recognized by the City of Woburn; 4. All dumpsters shall be enclosed, by means of a fence, wall or landscaping in compliance with the Woburn Zoning Ordinances; 5. There shall be adequate rodent control in place prior to commencement of any site disturbance and maintained throughout all site development and construction phases. The Petitioner shall provide monthly rodent control reports to both the Board of Health and the Department of Inspectional Services; 6. As-built plans shall be provided at the conclusion of the project to the satisfaction of the Engineering Department and Department of Inspectional Services; 7. The issuance of this Special Permit Decision is contingent upon the execution of an Easement Agreement between 288 MISHRD LLC and Woburn Avalon, LLC and Woburn Edens, LLC in their capacities as trustees for the Woburn Place Commercial Condominium Trust and Woburn Edens individually granting to the Petitioner an easement to allow for ingress to and egress from the Petitioner's Property. The Petitioner shall provide to the City Council a redacted copy of said Easement Agreement prior to the issuance of the Special Permit Decision; 8. Prior to occupancy, the Petitioner shall be responsible for installing shut off valves to both the domestic water service and the fire protection water service at the exterior of the building to ensure that either service can be shut off independently; 9. Prior to occupancy, the Petitioner shall complete a fire flow test at the nearest hydrant to ensure adequate flow is available for fire protection; 10. Prior to occupancy, the Petitioner shall "telecamera" the existing sewer line from Mishawum Road to the building in order to ensure it is adequate to service the proposed use; 11. This Special Permit is contingent upon the issuance of an Order of Conditions by the Woburn Conservation Commission (and/or Superseding Order of Conditions issued by MassDEP) pursuant to the Massachusetts Wetlands Protection Act, and implementing regulations (310 CMR 10.00 et seq.). Prior to submission of a building permit application, any material changes required in the Project as a result of the issuance of an Order of Conditions, shall be reviewed by the City Council pursuant to Condition One; 12. Parking Monitoring - The Petitioner shall implement a post- development parking monitoring program that focuses on the site's 41 designated parking spaces. The first monitoring program should take place within four (4) weeks of the enrollment at the facility reaching 120 students. The monitoring program shall be repeated at an enrollment of 150 students and again at 180 students enrolled. In each instance, the monitoring report shall be conducted during traditional morning drop-off (7-9am) and evening pick-up (4-6pm) peak periods for the Child Care facility and shall be conducted during periods of the year when occupancy levels are normal (i.e., non-summer and non- holiday periods). The monitoring report shall be submitted to the City Engineering Department and City Council and shall include the results of the monitoring and observations of parking activity during pick-up/drop-off time periods, and an indication of if the parking supply is adequate for the demand at the site. If, in the opinion of the City Engineer, the parking supplies are noted to be full and/or vehicles are observed congesting the drive aisles within the site, the Petitioner shall coordinate with the City Engineer's office to develop and implement corrective measures and/or modifications to the parking operations plan that would increase the supply of parking spaces available to those parents, guardians, and other transport providers during the peak hours of the day; 13. Snow Removal - Snow storage and removal shall be in accordance with the Petitioner's snow storage plan. In all circumstances, snow relocation from the parking areas shall take place as soon as practicable following a storm event. If the results of the parking monitoring report noted above indicate that the parking supply is limited, the snow shall be removed from the site and properly disposed of within 48 hours of a storm event; 14. Site Plan Changes - The Petitioner shall make the modifications to the site plan package that the site engineer agreed to as part of the peer review process in accordance with their response letter dated, "September 14, 2023 from Patrick Connolly of Beals Associates to the Woburn City Council" including appropriate notes, additions, and clarifications; 15. Mitigation for this Project shall be as follows: Subject to approval from the Woburn Traffic Commission, the Petitioner will pay for the installation of school signage in accordance with the Manual on Uniform Traffic Control Devices (MTUCD) to advise road users on Mishawum Road they are approaching a school area. One sign is proposed in each direction of Mishawum Road in advance of the existing site driveway; 16. No left turns shall be allowed out of the site onto Mishawum Road. In addition, the Petitioner shall install a concrete median with rumble strips forcing vehicles to turn right when exiting the site; 17. All students shall be escorted into the Child Care Center by an adult. There shall be no "dropping off" of students at the entrance of the Child Care Center; 18. This Special Permit shall be issued to BrightPath Early Learning LLC and 288 MISHRD LLC (jointly the "Petitioner") and shall not be transferable except the Special Permit may be transferred or assigned to any successor and/or assignee of the Petitioner that uses the site for the same or similar use; and the following finding: The City Council finds that the use of the nonconforming structure as a child care center is less detrimental that the prior uses that previously occupied said nonconforming structure, all in favor, 8-0-1 (Ferullo Absent)..”
