“MOTION made by Mr. Beaudette, seconded by Mr. Medeiros, to have a second discussion on the proposed Mobile Food Vending Policy. Board of Selectman's Meeting Minutes 1|Page Page |2 The Policy discussion will be continued for a Third Meeting before Board approval. DISCUSS AND VOTE ON SEARS LANDFILL MEMORANDUM OF AGREEMENT AND LICENSE At 6:47 PM Mr. William Anderson, Highway Director, Mr. Alasdair Cunningham and Mr. Robert “Bob” Delhorn, of Charter Landfill, LLC were present at the meeting. Mr. Anderson stated this was the second time the Board of Selectmen discussed the landfill capping project and clarified the vote was for Charter Landfill, LLC to access the road. Mr. Anderson presented plans for the “Swansea Landfill Corrective Action Design on Sears Road” for public viewing. He stated a recent newspaper article in the Fall River Herald contained incorrect information and clarified the proposed landfill height would be 70 feet above sea level and the current level of the landfill is approximately 50 ft above sea level; He clarified the proposed landfill capping will result in approximately 20 feet of height change. He stated if the landfill is not capped, the Town could face liability. Several residents spoke with questions and opposition to the landfill capping including: Mr. Gary Lund, Mr. James Pelletier, Mr. David Fernandes, Mr. Kenneth Baker, Ms. Joyce Moore, Mr. Steven Marques. Mr. Mark Shane and Mr. Ron Dupont of Swansea, Massachusetts. Mr. Beaudette and Mr. Medeiros asked questions clarifying the visual aesthetics of the landfill capping from GAR Highway, traffic patterns with access to Sears Road. Mr. Alasdair Cunningham and Mr. Robert “Bob” Delhorn of Charter Landfill, LLC were present to answer all questions from Town residents and the Board. They confirmed the current vote presented before the Board is strictly to grant Charter Landfill, LLC access to the landfill via Sears Road and not approval of the landfill design or logistics itself. The landfill capping is regulated by Massachusetts Department of Environmental Protection and multiple public meetings were held between 2023 and 2025 regarding the landfill capping, allowing public input. Board of Selectman's Meeting Minutes 2|Page Page |3 Charter Landill has agreed to fix Sears Road and install utilities at no expense to the Town. The project will comply with the Massachusetts Department of Environmental Protection Regulations (MassDEP), and that the landfill will be screened for vegetation on an annual basis. The capping project will have a layer of vegetation and trees and is said to be beneficial for economic development. Oversight will include annual third-party inspections to ensure compliance. Mr. Cunninham shared an example of a recent landfill capping completed by Charter Landfill Services in Lynn Massachusetts that was transformed into a Waterfront Park. In conclusion of the two-hour discussion, it was confirmed that the Board's failure to act on granting the license could expose the Town to multi-million-dollar liability. If the waste were not on the Town's property, this matter would not be brought before the Board of Selectmen. Mr. Kitchin stated that there will be additional considerations regarding the project with the Soil and Conservation Board, as well as further clarification from the Department of Environmental Protection for the Town. ROLL CALL VOTE to sign the Memorandum of Agreement and License between Charter Landfill Services, LLC and the Town of Swansea for the purpose of access to the Town-owned parcel on Map 58, Lot 2 to remove landfill wa.” (Motion: Beaudette, second: Medeiros)
