Approve contingent on other board approvals and Health and Building code compliance
“Mr. Fee moved approval contingent on other board approvals and Health and Building code compliance; seconded by Ms. Holdgate. Attorney Ken Gullicksen, representing the applicant, noted that a restaurant is permitted at the location by right for up to 70 seats. He expressed concern that if the Planning Board doesn’t vote to approve the proposed seating expansion, that decision would nullify the Select Board’s vote. Some discussion followed; it was agreed by Board members that if the applicant has issues with the Planning Board and they wish to go the by right route, they will need to come back before the Select Board for a new hearing. On the motion, by roll call vote: Chair Mohr – Yes; Mr. Dixon – Yes; Mr. Fee – Yes; Ms. Holdgate – Yes; Dr. MacNab - Yes; so voted 2.” (Motion: Fee, second: Hill)
