“Ms. Mohr moved approval; seconded by Ms. Holdgate. Mr. Fee said he is less supportive of this request than the prior request. He said he would prefer to have other ways of retaining employees, rather than this. Chair Bridges said he agreed with Mr. Fee but also supports this request, now. Ms. Mohr concurred and said other strategies to retain employees are more long-term. She added that this is also an important … as a raise and will “never go down”. Some additional discussion followed. So voted Chair Bridges - Yes; Mr. Fee – Yes; Ms. Mohr – Yes; Ms. Holdgate – Yes. Ms. Perry, Chief Pittman, Mr. Arceneaux and Mr. Gray left the meeting at 9:27 AM. Energy Coordinator Lauren Sinatra, Water Department Director Mark Willett, and Attorneys Vicki Marsh and George Pucci from Town Counsel’s office joined the meeting at 9:27 AM. 4.” (Motion: Mohr, second: Hill)

Authorize defense of litigation with this matter and that the two conditions as proposed by the Land Council are rejected
“Ms. Mohr moved to authorize defense of litigation with this matter and that the two conditions as proposed by the Land Council are rejected; seconded by Ms. Holdgate. Ms. Mohr suggested that the Board counter propose the previously discussed “side letter” regarding limitation of use of the property. Some discussion followed. Mr. Willett said that the Water Commission shares the position of the Select Board and that he is meeting later today with the Land Council regarding the idea of a letter or lesser permanent restriction. He said he would be willing to explore ways to retain the mitigation fee(s) locally. So voted Chair Bridges - Yes; Mr. Fee – Yes; Ms. Mohr – Yes; Ms. Holdgate – Yes. Chair Bridges commented on the amount of mitigation that has already occurred with this project.” (Motion: Mohr, second: Hill)

Authorize Town Counsel to draft and file an appeal by October 14th and to have Mr. Holland and Mr. Beaugrand notify the developers as such – unless a written agreement has been prepared and agreed to by October 13th, that would 1) commit the developers at their sole cost to provide 25% of the units (39 units) restricted at 80% AMI required under Chapter 40B and in addition commit to providing another 25% of the units (an additional 39 units) restricted to year-round only for a minimum of 30 years (the so-called “Standard Finish” units) with agreement to use their best efforts to affect a renewal mechanism or deed restriction held by a third party that would in effect allow the units to be year-round restricted in perpetuity at the Town’s option; and 2) would commit the project to a requirement that anything less than a year-round rental would be limited to one rental per year for no more than 30 days (except where DHCD requirements on the 80% AMI units may be more restrictive). If and when this written agreement is complete, the Town would forgo pursuing the appeal
“Ms. Mohr moved to authorize Town Counsel to draft and file an appeal by October 14th and to have Mr. Holland and Mr. Beaugrand notify the developers as such – unless a written agreement has been prepared and agreed to by October 13th, that would 1) commit the developers at their sole cost to provide 25% of the units (39 units) restricted at 80% AMI required under Chapter 40B and in addition commit to providing … Fee seconded for discussion. Mr. Fee asked where the ZBA would stand on this. Mr. Pucci said he was not sure but believes it would accept this vote. Mr. Fee re-expressed his concern about this decision being too rushed and is not sure he can support it. Further discussion followed. So voted Chair Bridges - Yes; Mr. Fee – Yes; Ms. Mohr – Yes. Mr. Fee reiterated that he does not believe the Town is asking for enough.” (Motion: Mohr, second: Fee)
