“Chair Zoll moved to enter Executive Session to discuss strategy with to respect to potential litigation regarding M.G.L. c. 40A, Section 3A (the "MBTA Communities Act") and 760 CMR 72.00, based on my belief that discussion of this matter in open session may have a detrimental effect on the litigating position of the Select Board. The Select Board will return to Open Session. The motion was seconded by Mr. Wells. The Board voted unanimously by roll call (5-0) to enter Executive Session. HAGGERTY: YES DALEY: YES KEOHANE: YES WELLS: YES ZOLL: YES.” (Motion: Zoll, second: Wells)
