To approve the annual alcoholic license to Concert New Seabury LLC dba The Lure of Popponesset
“Motion made by Selectman Cotton to approve the annual alcoholic license to Concert New Seabury LLC dba The Lure of Popponesset. Motion seconded by Selectman Richardson. Selectwoman Kelley-Wilson stated that she was still considering whether the Board could issue the license on a provisional basis, noting that she would not want to establish a precedent unless such an approach had been used in the past. Chair Wyman-Colombo responded that the Town has previously issued annual licenses at two establishments. Selectman Cotton expressed concern that placing exceptions or conditions on the license could itself create a precedent, stating that there is no routine enforcement mechanism actively monitoring licenses and that imposing additional restraints on an ABCC-issued license could introduce a new and unintended standard. He further noted that, at present, the Board is simply allowing the establishment to operate on a year-round basis under an annual license. Vote: 5-0 Unanimous Roll Call Vote Selectwoman Wyman-Colombo-yes Selectman Weeden-yes Selectman Cotton-yes Selectwoman Kelley-Wilson-yes Selectman Richardson- yes.” (Motion: Cotton, second: Richardson)
