2. C0287-24 Public Hearing/s/ Councilor Robert J. Van Campen, as President A petition from Trimount ESS LLC requesting permission to install an underground electrical duct bank, inclusive of an electrical transmission line, as described herein. Public Hearing was held. Hans Detweiler and representatives from Jupiter Power LLC/Trimount ESS presented their proposal to install an underground electrical duct bank and transmission line. Key points: - It would connect their proposed battery storage facility on the former Exxon tank site to substations, providing grid stability services. The location takes advantage of existing grid infrastructure. - They expect to be a significant taxpayer, though exact amounts are still being determined. A draft PILOT agreement has been submitted to the city. - Construction would create union jobs under a project labor agreement, with a program to create a pathway from Everett High School to building trades jobs. - They have done extensive community outreach and made changes based on feedback, like attractive wall plantings, bike path continuity, and an annual student art program. Several union representatives and residents spoke in support, citing the outreach, job opportunities, and environmental benefits. In discussion, councilors asked about the size, exact tax revenue projections, fire safety plans, and status of a host agreement. 4. C0331-24 Order/s/ Councilor Robert J. Van Campen, as President An order requesting approval to accept and expend a grant from the Massachusetts State 911 Department in the amount of $206,970 which will be used by the Everett Emergency Communications 911 Department to defray the cost of salaries for enhanced 911 telecommunicators Eric Demas explained this is an annual grant the city receives to support 911 department staffing and ensure adequate training. The funds offset what would otherwise need to be requested in the city budget. Councilors asked for clarification on what "enhanced 911 telecommunicators" meant and if it would fund new positions. Demas said it refers to training for existing staff required by the state. The grant defrays existing salary costs, it does not add new positions. 9. C0137-24 Ordinance/s/ Councilor Katy L. Rogers An ordinance requiring all playing fields in Everett to use environmentally sustainable organic grass instead of artificial turf Councilor Smith reported concerns raised in committee about the appointee's lack of elections experience, having only voted once herself in 12 years despite being the director. The increased salary was meant to attract experienced candidates. Smith said she cannot support the appointment. Councilor Martins said she will vote in favor, knowing the appointee personally and believing she will do her best and abide by the rules, despite preferring someone with more experience. Councilor Garcia asked what happens if the appointment fails, with an election upcoming. The clerk said the mayor's appointee continues as acting director until the mayor appoints a successor the council confirms. Councilor Pietrantonio questioned how one can oversee elections with no experience and only voting once. Van Campen, as President An order requesting that the Everett City Council discuss and vote on an appeal of a 30-day suspension of the Second Class Motor Dealer License granted to Boston Motor Sports located at 47 Mystic Street. Attorney Mike Kelly, representing Boston Motor Sports, argued: - The 30-day suspension stems from a misunderstood incident in 2022 where a customer test driving a car was mistakenly thought to be using the car for hire. The dealership does not rent cars. - The dealership has been trying to get its license back since 2022. A recent appeals board ordered it reinstated pending inspection, which hasn't occurred. - Alleged zoning violations have been or will be addressed. The owner does work sufficient hours there. Trooper Lawrence and Sergeant Gaff detailed a pattern of violations and uncooperative behavior by the dealership over two years, including: - In February 2022, two separate traffic stops found paper license plates from the dealership, one apparently counterfeit. This led to plate confiscation and a 30-day suspension. - Inspections before and after have found used car inventory records incomplete, too many cars on the lot, and plates being misused on cars for test drives. - The dealership has been uncooperative in addressing issues. The owner, who is the license holder, is rarely present. Councilors discussed options, seeking a balance between giving the business another chance and protecting public safet

Deny the appeal and conditionally reinstate the license past the 30-day suspension, subject to inspections by the city clerk, police, and state police. Impose a 90-day probationary period where any violations can trigger immediate revocation hearings. The city clerk recommended a conditional reinstatement allowing him to re-inspect and verify all violations are addressed before returning the license. Any further violations through year-end would allow immediately revoking the license. The license is up for renewal in 60-90 days where additional conditions could be set. 22. C0328-24 Resolution/s/ Councilor Holly D. Garcia That the city considers giving staff parking stickers to all Everett Public Schools employees for use in school parking lots Councilor Garcia said teachers reported issues with school parking lots designated for staff being used by neighbors for overnight parking. A taxi was even parked in one school lot for a day. The traffic department responded quickly by posting signs designating the lots for teacher parking only from 7am-3pm. However, Garcia fears signs alone won't deter violations. She proposes issuing stickers to teachers and school staff to place in their cars, clearly marking their authorized parking status. This would aid parking enforcement in ticketing violators. Refer resolution to Parking Department MOTION: Refer MOVER: Holly Garcia SECONDER: Katy Rogers RESULT: Passed [0 TO 0] AYES: NAYS: AWAY:

Refer — Resolution: That the administration considers allocating funds to add multilingual translation services to city council meetings
24. C0330-24 Resolution/s/ Councilor Holly D. Garcia, Councilor Stephanie Martins, Councilor Guerline Alcy-Jabouin That the administration considers allocating funds to add multilingual translation services to city council meetings Councilor Garcia said this request, for the administration to fund translation services at council meetings, has come from residents since before her tenure. It's an important need to include residents. Councilor Martins clarified the council process requires the mayor to propose an appropriation, unlike the school committee which funded translation services directly. She suggested referring the item to both the administration and council president. Councilor Hanlon agreed translation is needed, noting several residents gave public comments entirely in foreign languages, which he could not understand. Based on public comments, he believes 4 languages may require translation. He supports referring it to the mayor. Garcia, Councilor Guerline Alcy-Jabouin, Councilor Wayne Matewsky, Councilor Peter Pietrantonio Resolution calling for the passage of question 2 to replace the MCAS graduation requirement Councilor Martins moved to allow any other councilors to be added as cosponsors. The final resolved clause supports passing ballot question 2 to replace the MCAS graduation requirement with a determination that students have completed local district graduation standards. Councilor Hanlon opposed the resolution, arguing MCAS incentivizes achievement and removing the requirement will lower standards. Councilors Garcia and Rogers supported the resolution based on their experiences with MCAS in Everett schools. They argued "teaching to the test" hindered their education, and a single test should not overrule a student's entire academic record or dictate their future. 26. C0333-24 Ordinance/s/ Councilor Guerline Alcy Jabouin An ordinance that the City Council consider voting to remove the TDM ordinance Councilor Alcy Jabouin argued the Transportation Demand Management (TDM) ordinance has allowed developers to overbuild with insufficient parking. Despite widespread resident opposition to overdevelopment voiced at zoning and planning board meetings, the boards say their hands are tied by the TDM ordinance - only the council can change it. She asked for a favorable vote to remove the ordinance. Councilor Smith asked if removing the ordinance would leave a void needing to be filled. Councilor Pietrantonio suggested it would revert to the prior ordinance requiring 2 parking spots per unit.
