To have a hearing to amend the license

Yes: Flanagan, McMahonNo: LambtonJohn Terrio stepped aside (recused) and did not take part in this vote. Paul McCormick stepped aside (recused) and did not take part in this vote.

From the minutes

“Ms. McMahon moved to have a hearing to amend the license; Mr. Flanagan seconded. Mr. Lambton assured everyone we take this seriously. Fire, Police, Building, Health and Tax sign off. The police records of calls to Chapin's show there was only one noise complaint. A licensing hearing in large part would be investigated by the Police Department. Mr. Flanagan shared that he lives down by Wolfies' bakery. When this was approved he was trying to support businesses. There was no way of knowing if things will change this summer and this is a way to provide safe entertainment. He encouraged Ms. Lorden to call the police when threatened or people were trespassing on their property. Tonight, was procedural they would need to hold a hearing not to renew the license. Mr. Lambton suggested setting up a meeting with licensees to communicate the concerns. Ms. McMahon pointed out that there was communication from Attorney Corbo. The Board may base action on complaints from neighbors. They had an obligation as the licensing board to hold hearing. Mr. Lambton felt there was not enough to warrant a show cause hearing. He was concerned with affecting Chapin's ability to conduct business. Mr. Flanagan felt a show cause indicated there was a wrong doing. This is more concerns. Ms. McMahon stated this deserves more due process and Mr. Mullen deserves a chance to speak on this. The Board voted: Mr. Flanagan "aye", Ms. McMahon "aye" and Mr. Lambton "no".” (Motion: McMahon, second: Flanagan)
