Board send the following approved letter to residents recently corresponding with the Select Board about Reservoir Pond issues. The letter is as follows: August 18, 2020

From the minutes

“Motion was made by Mr. Porter, that Board send the following approved letter to residents recently corresponding with the Select Board about Reservoir Pond issues. The letter is as follows: August 18, 2020 Dear Resident, Thank you for your recent correspondence regarding Reservoir Pond. We have received other letters similar to yours outlining concerns about the use and control of the Pond and the effect of accepting the state Grant for improvement of the Earl Newhouse WaterFront area. We would first like to address the issue of "control" of the Pond. The Select Board has been consistent in its continuing efforts to keep control of the Pond local. The Board has been successful in acquiring control of the water body by two means; first, through purchasing the Pond from the private party that owned it, and second, by petitioning the Commonwealth to have the water body delisted as a "Great Pond." Moreover, after the Town purchased the Pond, it issued boating and use regulations designed to balance recreation with safety and stewardship of the environment, including water quality. The "control" issue that has been primarily brought to our attention by letter writers is that upon acceptance of the state Grant, the Town would be unable in the future to limit use of the Pond solely to Canton residents. According to some, one justification for the original purchase of the Williams Estate with local funds was to be able to regulate access to the Pond and the estate property. That reasoning, however, would have been in error because at that time the Pond was classified as a Great Pond and therefore, the Town could not legally limit access to residents only. Today, thanks to actions of the Town, the authority to use or limit use of the Pond rests with the Select Board. That authority will remain, notwithstanding acceptance of the state Grant, so that in cases of potential overuse, drought, or for safety reasons, the Select Board may further regulate use with the proviso that there can be no outright prohibition on non- resident access. The Board is of the opinion that the regulations now in place and coupled with assistance from the Commonwealth's Environmental Police and with measures to be taken at the upcoming May 2021 Town Meeting to assist in enforcement, the control issue is in strong local hands. A number of letter writers have questioned the Moderator's management of the June 2020 Town Meeting vote on Article 33. Town Counsel has opined that the meeting was.” (Motion: Porter)
