From the minutes

“Question of reviewing and accepting reports on the following articles referred to the Select Board by Town Meeting: c. Annual Town Meeting May 2023 Warrant Article 17 - Amend Article 8.37.2 of the Town's General By-Laws to change "marijuana" to "cannabis" and to permit two additional Storefront Cannabis Retailers licenses for Equity Applicants (O'Neal). Town Administrator Chas Carey reviewed the report on Article 17 of the May 2023 Town Meeting: Referral of May 2023 Annual Town Meeting Warrant Article 17 Amend Article 8.37.2 of the Town's General By-Laws to change "marijuana" to "cannabis" and to permit two additional Storefront Cannabis Retailers licenses for Equity Applicants At the 2023 Annual Town Meeting, the portion of Warrant Article 17 that called for the creation of two additional Storefront Cannabis Retailers licenses was referred to the Select Board for further study. Specifically, Town Meeting requested that the Select Board evaluate the thenforthcoming regulations from the Cannabis Control Commission ("CCC") and determine whether the addition of such licenses was mandated by those regulations if, as was then the case, Brookline had no licenses issued to CCC-certified Economic Empowerment or Social Equity businesses. The answer to Town Meeting's question is no: there is no obligation, under statute or CCC regulations, for the Town to issue additional licenses if no current licensees are Social Equity or Economic Empowerment Applicants. Any future licenses that may become available are subject to the new CCC requirements for equitable distribution, however. The CCC's new regulations, and proposed updated regulations, can be read here: https://masscannabiscontrol.com/public- documents/regulations/. Additionally, the Town's equity policy, which the Select Board revised after Warrant Article 17 was proposed but before Town Meeting that spring, states that Brookline will accept future applications only from businesses with Economic Empowerment or Social Equity status until April 4, 2026. Finally, since Warrant Article 17 was referred, one current licensee, Comm Ave Canna, has been certified as a Social Equity business by the CCC. The Select Board continues to prioritize equity in cannabis retail, while acknowledging that the market has shifted dramatically since the first recreational licensee began selling in Brookline in 2019. Approved Aye: Bernard Greene, John VanScoyoc, Michael Sandman, Paul Warren, David Pearlman.”
