Engage the services of the Cape Cod Commission to help with this Memorandum of Understanding process
To engage the services of the Cape Cod Commission to help with this Memorandum of Understanding process. Mr. Meier said that this is going to be a fluid document and will change and have many iterations. He said that the Cape Cod Commission may even think of things that the Select Board isn't even thinking about. Chair Ferretti said that they know they are going to have a lot of impact from these bridges, but she has not heard a lot in Bourne about the benefits that the bridges are going to give them. She said that the new bridge is needed. Rob Manson of Monument Beach said that he echoes Chair Ferretti's sentiment. He said the new bridges will be better in the long run. He said that as part of the MOU, he thinks the town should request removal of the F2 and construction of the Bourne Rail Trail as a mitigation for the impact and disruption that there will be to the Canal recreation path. He said it is the perfect opportunity to make a change that will benefit the residents of Bourne for generations to come. He said if a track is deemed to be necessary, a new track could be built along the east side of 28 to ISWM or the base. Mr. Meier also said that they need to engage MassDOT Rail Division to get access at Monument Beach open on a permanent basis. John York seconded what Mr. Meier said. He talked about the reasons they voted for the money for this access. Mr. York talked about why he feels an MOU is needed. Peter Murner thanked the Select Board for finally putting the MOU d

He talked about the reasons they voted for the money for this access. Mr. York talked about why he feels an MOU is needed. Peter Murner thanked the Select Board for finally putting the MOU discussion on the agenda, and he said that the conversation should have happened years ago. He said that he has an issue with the first step being taken by kicking the can to the Cape Cod Commission. He said this is the same Cape Cod Commission who should have been recommending this years ago. He added that he does not think they should put all their eggs in that basket. He also said that he provided templates on the MOU process and documents. He said the next step is the mitigation plan. He added that this will not be solved with an MOU, as they do not know all the problems right now that will need to be solved. Mr. Murner also said that the state's environmental justice report on this project is essential for review and understanding. He said that massive opportunities are outlined in the document about how to frame this MOU using the language of the state itself. Ken Cheitlin said that this is Bourne's opportunity to ask for something in return for being the town that is going to take the brunt of this project. He said the MOU is a procedures document, but it is also a negotiation. He said that as far as the Bourne Rail Trail is concerned, the single most important thing that MassDOT could give in connection to it is an agreement to look at the design of a new track to run from the canal to Join Base Cape Cod or the ISWM Facility, or both. Vote: 5-0-0.” (Motion: Meier, second: Mastrangelo)
Request MassDOT to give any documents in advance of the July 23rd Public Hearing
To request MassDOT to give any documents in advance of the July 23rd Public Hearing. Mr. York said that this is not just the Design Public Hearing, it is the 25% Design Public Hearing. It is a required part of every highway production construction process. He reiterated what Ms. McCollem said about it being a chance for the public and public officials to enter into the record their desires, views, questions, and suggestions for anything about the construction project. He also referenced a 20-page document that is included in the 25% Design Public Hearing. Mr. Murner said that this is why they need the MOU before that meeting or at least request it. He said they need to have it on record so when he shows up at the meeting, he can ask why they have not responded. Ms. Mastrangelo said she would like to be able to look at the 20-page document that Mr. York referred to. Mr. York said that he would send her links.
