To recommend that they concur with the determination that the use as described in the draft de minimis impact determination letter dated May 15th would not adversely affect the activities, features, and attributes that qualify the resources for protection under Section 4F, subject to concurrence from Town Counsel. Ms. McCollem said she would like to confirm that the Select Board is authorizing her to sign the May 1th, 2026 Cape Cod Bridges Section 4F de minimis impact determination request for concurrence Keith Field Recreation Area, Bourne, MA letter, subject to confirmation that she receives from Town Counsel that the subject of the letter is specific to the shared use path only. The Select Board all agreed. John York said he is concerned and said there is still a gray area in what they are asking Town counsel to review. He suggested to the Select Board to have Town Counsel look at the traffic flow as well. Ms. McCollem said that she does not recommend that Town Counsel and the Legal Budget is used to review MassDOT's entire 4F permitting process with all due respect. She added that it is not Town Counsel's role. Ms. Mastrangelo said that she just wants to know what they are signing off on.
